Milestones and Fixed Price

Hello people,

So I am having this project that I look to spend around 5.5 K - it is the clone of the website and before I put any freelancer to do the job I want to ask this.

What if we establish the milestones and my freelancer chooses to do the first one but refuses to do others e.i. Completed the first one but doesn't want the second one.
I assume that I paid him for the first one - Do I get the refund since he didn't finish the whole project.
