Urgent : Refund my Escrow payment

Hello,

My developer always promising to do the job and i am not happy with their slowly work attitude , they promised me to do my application in about 3 months and it takes already 6 months. Can i get refund back from escrow without the sellers approval? I want to quit working witth my developer.
