2 Ideas for PPH, Fee and TOS changes
I am CERT 5 in PPH but i have been recommending this 2 changes for a while, please do take notice.
-PPH 15% fee was excellent, the 20% fee is a bit too much, specially since jobs are not as plentiful as with other sites. Please reconsider changing it back to 15%. This has increased costs for buyers who are less willing to assign projects now.
-Recently i had a dispute with a customer, even though i won that dispute over PPH, he is seeking legal action in his jurisdiction, he has the right for that, HOWEVER. I have not deal business in his jurisdiction, in you terms of service, there should be included a section where both parties agree to proceed with legal action on the basis of the Law of England and Wales, as it is now, it only cover PPH from legal proceedings, but not disputes between buyer/sellers. Understand that this is a global business, And if i live in Country A, clients lives in Country B, C, D, E, F..... people cannot be defending themselves on each clients/providers jurisdictions. So the Law of England and Wales, which is YOUR jurisdiction should be explicitly taken for disputes. That way there is only one jurisdiction to be applied. Also the UK is an extremely fair and honest jurisdiction for disputes. Please do add something on your TOS like this.
-Buyers and Sellers, agree to take any legal disputes over to the Law of England and Wales, and waive any other jurisdiction. (Consult your lawyers)
