Job Completion Issue

Dear PHP, 

I am working on the tender with a consultant. We had the mutual discussion about the bidding requirement. The consultant was aware of it and promise that he will deliver the job in time. Now, this very person is delaying my job. I can't contact him some time, and he wants to meet in the later days. 

This is unacceptable. Can I cancel and claim the refund for my deposit?
