Refund

I made the mistake to pay the invoice before the job was totally completed.
After the payment and although the freelancer agreed to finish the job he disappeared. He has apologized, since then wince, still, the job has not to be finished yet.
I told him that I will ask for a refund. Am I eligible, and what are the steps that I have to take to do so.
